These terms and conditions (”Terms and Conditions”) apply, when you order or buy goods on this website. The Terms and Conditions may be updated from time to time (for instance to reflect changes in technology, our business model, our system capacity or in relevant laws and regulations). For this reason, we kindly ask you to agree our Terms and Conditions prior to every purchase you make. Any reference to “you” or “your” refers to you as a user of our website. Any reference to “we”, “us” or “our” means Nordahl Andersen.

 

If you do not accept these Terms and Conditions, you cannot order or purchase any goods on our website.

 

You have the right to withdraw from this contract without any statement of grounds within 30 days after the date on which you or a third party named by you, other than the carrier, takes the goods in physical possession. Read more under “Right of withdrawal”.

 

The rights arising from product defects of the sale of goods law apply to your purchase, which means that you have certain statutory warranties for the quality of your goods. You can read more under “Defective goods and incorrect goods”.     

 

 

  • 3 ORDER

The online shop is open 24 hours a day but may be closed due to maintenance services. We try to perform such maintenance services during the night, to the extent deemed possible.

 

An order that was placed on a public holiday will be processed on the following working day.

You must be at least 18 years old, to purchase goods on the website. Additionally, you must be in possession of a valid payment card, that is accepted by us. If you are under 18 years, you need a legal basis for concluding a contract with us.

We reserve the right to cancel the contract of purchase in any of the following situations, without being liable for compensation or other costs:

  • Your payment details are incorrect or cannot be verified
  • Your order is placed with the purpose of committing fraud etc. or placed in connection with a criminal offense or other unlawful activities
  • There is an inadvertent error on the website, such as a payment error or the like
  • We have reasons to believe that you are under the age of 18

Contracts can only be concluded on the website. We do not process orders placed by emails, letters, or faxes.

 

AT WHAT POINT IN THE ORDERING PROCESS ARE YOU BOUND BY YOUR ORDER?

Before submitting the order, you have the option to make changes to your order or to remove goods from your shopping cart.

 

When you click "Pay" a receipt appears on your screen. From this moment on you are bound by the contract of purchase. Please read more under "Right of withdrawal".

LANGUAGE OF THE CONTRACT

This contract may only be concluded in Danish, English or German.

 

ACCESS TO THE CONTRACT

You will receive an e-mail confirming the content of the contract. We store concluded contracts, including the order confirmation, for a certain amount of time, and we recommend you to save these documents as well, since they will not be accessible later on the website.

 

MEASURES AGAINST FRAUD

In order to protect you and other customers against fraud and to maintain a high level of security for online purchases, we may carry out verification checks. The verification check may comprise the data that you provide, when placing an order on the website, including your address and payment information.

 

 

  • 4  PAYMENT METHOD

We accept the following payment methods:

CREDIT CARD VERIFICATION NUMBER (CVV)

If you pay by credit card, you will be asked to enter the card's security code. You can find the three-digit security code on the back of your credit card, usually on the right side of the credit card's back. The security code is necessary for the payment to be processed and for maintaining a high level of security. There may also be other similar safety precautions.

TWO FACTOR AUTHENTICATION

You will be asked to provide your mobile number. Thereafter, you will receive a text message with a code you shall enter in the end to complete the payment.

 

PAYMENT PROCEDURE

When your goods leave our warehouse for delivery, your payment will be debited from the selected payment service.

 

 

  • 5  PRICES

All stated DKK prices for goods, shipping costs, as well as other costs include taxes, VAT and duties.

Prices in other currencies for goods, shipping costs, as well as other costs are exclusive taxes, VAT and duties.

The prices on the website are shown in the currency applicable to your country. Please use the function “Choose currency” at the head of the website.

  • 6 DELIVERY

Goods will be delivered to the delivery address stated when placing the order. We deliver to private and business addresses.

The table below shows the expected delivery time, freight prices and delivery method.

When shipping your order, you will receive a text message stating that the order has been sent from Nordahl Andersen, who handles all charitybynoa shipments. Please note that the risk for the goods is transferred to you upon delivery. If the packaging looks damaged, you should contact Nordahl Andersen.

Purchases with minimum value of DKK 500 / EUR 65 / GBP 60 / SEK 700 will be shipped with no postage charged.

 

 

 

 

 

 

The indicated delivery times are approximate. In times of high workload, a longer delivery time is to be expected.

If you do not pick up your shipment, it will automatically be returned to Nordahl Andersen. In these cases, the postal charges will not be refunded.

 

 

  • 7  RIGHT OF WITHDRAWAL (only applicable to consumers)

You have the right to withdraw from this contract without any statement of grounds within 30 days.

The right of withdrawal applies 30 days, from that date on, on which you or a third party named by you, other than the carrier, takes the goods in physical possession.

 

In case of a contract relating to multiple goods ordered in one order but delivered separately (i.e. separate deliveries), the right of withdrawal applies 30 days from that date on, on which you or a third party named by you, other than the carrier, takes the last goods in physical possession.

 

To exercise the right of withdrawal, you must inform us about your decision of withdrawing this contract by an unequivocal statement (for example by a postally delivered letter or an e-mail). We kindly ask you to use our return form . Of course you can also contact our customer service at [email protected], who will be happy to help.

 

Once we have received and processed your return form, we will send you an e-mail with a return label, which you are to print and attach on the package. After this, you hand in the package at the closest PostNord/DPD post office/package shop.

The item must be unused and in original packaging. Please enclose a copy of the invoice in the package, if possible.

I case you decide to return the goods in a different way, you bear the responsibility and the postage of the return consignment.

 

The money will be refunded the same day or the day after you received a credit note via email. Kindly note, that the money will be reversed to that payment method, which was used in the initial purchase.

The withdrawal deadline is met if you send your notice of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you exercise your right of withdrawal for this contract, we will reimburse to you all payments received from you, however not for a gift wrapper, without undue delay no later than 14 days from the day on which we are informed about your decision to withdraw from this purchase. We will carry out such reimbursement using the same payment method as you used for the initial purchase. You will, under no circumstances, incur any fees as a result of this reimbursement.

We may withhold the reimbursement until we have received the goods back.

We absorb the costs of the return consignment, as long as you send the shipment with a return label drawn up by us. Please use our return form or contact the customer service at [email protected]

Kindly send back the goods or hand them over to us without undue delay and no later than 14 days from the date on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

We recommend that you save the post office receipt as proof of your delivery of the package to the post office/carrier.

You are only liable for any diminution in value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and function of the goods.

 

 

  • 8 DEFECTIVE GOODS AND INCORRECT GOODS

If your goods are defective or we have delivered incorrect goods, please use our complaint form[MBH3]  or contact our customer service at [email protected]. If you notice the defect already at the time of delivery, you should refuse to receive the goods.

In case of defective goods or incorrect goods you can chose between the following options:

  • You return the goods and get refunded the purchase price as well as all the postal charges. Our customer service processes the returned goods and the money will be reimbursed within 1 – 2 days after you received a credit note via email. Kindly note, that the money will be reversed to that payment method, which was used in the initial purchase.
  • You return the goods and receive equivalent goods, provided that we can deliver such. The goods will be delivered to the address stated in the complaint form.

 

You are not responsible for costs associated with the return of defective goods or incorrect goods. We will refund the purchase price and the delivery costs once we have received the goods, unless you choose to receive new goods to replace the initial goods.

Once we have received and processed your return form, we will send you an e-mail with a return label, which you are to print and attach on the package. After this, you hand in the package at the closest PostNord/DPD post office/package shop.

In case you decide to return the goods in a different way, you bear the responsibility and the postage of the return consignment.

 

 

  • 9 OTHER INSTANCES

UPDATING THE WEBSITE

We do our best to update the website and to ensure that prices, offers, descriptions and other information concerning the goods are correct. We disclaim liability for print errors, typographical errors, errors concerning prices, offers, descriptions and other information concerning the goods.

FORCE MAJURE

We are not liable for delays or failure to meet our obligations in relation to these Terms and Conditions, if the delay or the non-compliance is due to events beyond our control.

COMPLETENESS OF THE CONTRACT

These Terms and Conditions constitute the complete terms of the contract between you and Nordahl Andersen.

INVALIDITY

If one or more of the provisions in these Terms and Conditions are fully or partially declared invalid, the remaining provisions still apply.

TRANSFER

We are entitled to transfer our rights and obligations according to the contract with you to a third party. This transfer is, of course, provided that the standard of service you receive will not be impaired. We will notify you of such a transfer. By accepting these conditions, you consent to any such future transfer. At the same time, you agree that from the time we have given you notification of the transfer, your rights may only be invoked against the third party in question.

PERSONAL DATA

We treat your personal data confidentially. Please read our Privacy Policy[MBH4] , which explains how we use the personal data that you provide in connection with the ordering procedure and your use of the website in general.

RIGHT TO COMPLAIN

Needless to say, you are always more than welcome to contact our customer service, in case you wish to complain about goods purchased from us. You can contact our customer service by phone, e-mail or ordinary mail. You can find the contact information under “General Information”.

Under article 8 “Defective goods and incorrect goods” you also find information on how we handle complaints regarding goods.

You can also make a complaint about an item purchased from us at Center for Klageløsning, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to Center for Klageløsning through the complaint portal of Nævnenes Hus.

 

You may also use the European Commission online complaints register when submitting your complaint. This is particularly relevant, if you are a consumer residing in another EU country. CHOICE OF LAW AND JURISDICTION

Any contracts concluded between us using these Terms and Conditions, are governed by Danish law. Any dispute, which may arise in connection with our contract, including its existence or validity, must be brought before a competent court in Denmark.
